Scott Llewellyn’s practice focuses on complex litigation in federal and state courts around the country, with an emphasis on patent and trade secret disputes. Over the past decade, he has worked on some of the most significant, high–profile IP cases involving technology for televisions, smartphones, and self–driving cars, relying on 40 years of experience with computer hardware and software. Scott also has significant experience with business divorce cases before courts and arbitrators, involving a mix of trade secret, patent, tort, and contract claims relating to technology development and implementation.Scott also has successfully tried general commercial arbitration and agency matters, briefed and argued various appeals in federal appellate court, and tried more than 20 cases for the Denver City Attorney’s office, most of them jury trials.Scott also has an active pro bono practice, having worked on a variety of criminal and immigration appeals, and having represented Colorado criminal defense and mental health organizations in high–profile suits against the state of Colorado for violations of the constitutional rights of defendants.At MoFo, Scott serves on the board of the Morrison & Foerster Foundation. The Digital Advertising Alliance (DAA) is continuing to adapt and plans to enforce its self-regulatory principles for interest-based advertising technologies.  Enforcement of its cross-device tracking principles will begin February 1, 2017.Cross-device tracking entails ascertaining via deterministic identifiers or inference when multiple devices are connected to the same person.DAA cross-device principles apply its inters-based advertising (IBA) self-regulatory notice-and-choice regime to cross-device tracking if browsing activity in one device may be used to deliver advertising on another device.  DAA requires a device-specific opt-out from (1) collecting data on one device to deliver IBA on another device, and (2) delivering IBA on a device based on information contained on a linked device.DAA announcement heralds the enforcement of compliance with this cross-device guidance “for all companies engaged in data collection and use covered by the DAA Principles.”The program has recently interpreted the DAA principles broadly in the mobile context, such as by requiring “enhanced notice” of IBA practices within mobile applications.  We expect that the DAA will take a similarly broad approach with respect to cross-device tracking.  Companies engaged in the collection and linking of information across multiple devices, therefore, should review their practices.Read the full Client Alert <a target="_blank" href="https://www.mofo.com/resources/publications/161024-enforcement-of-daa-principles.html">here</a>.

The Digital Advertising Alliance (DAA) is continuing to adapt and plans to enforce its self-regulatory principles for interest-based advertising technologies.  

On September 19, 2016, the National Telecommunications and Information Administration (NTIA) of the U.S. Department of Commerce announced the initiation of a multistakeholder process on security upgradability and patching relating to the IOT. The first meeting about this process will occur on October 19, 2016, in Austin, Texas.NTIA believes that, in order for the potential of the IoT to be realized, users of IoT devices “need reasonable assurance that connected devices, embedded systems, and their applications will be secure.” NTIA notes that “[a] key part of that security is the mitigation of potential security vulnerabilities in IoT devices or applications through patching and security upgrades.”NTIA’s view, such a marketplace requires a common language and standardized definitions across the ecosystem so that consumers will understand the security features of IoT devices and so that those devices can receive security upgrades in the same fashion that regular updates to applications and operating systems are currently facilitated using visible reminders and automated updates.
